  1. Introduction

These Terms and Conditions (“Terms”) govern your use of our website (the “Site”), your purchase of products, and any related services provided by Wisbys (“Wisbys”, “we”, “our”, or “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, you must not use our Site.

  1. Intellectual Property Rights

All content on the Site, including images, text, graphics, logos, icons, audio clips, digital downloads, data compilations, and software, is the exclusive property of Wisbys or its licensors and is protected by UAE and international intellectual property laws.

You may not copy, reproduce, distribute, modify, publish, or create derivative works from any content without our prior written permission.

We actively enforce our intellectual property rights to the fullest extent permitted by law.

  1. Copyright Infringement and Reporting Procedure

 If you believe any content on our Site infringes your copyright, please notify us immediately at info@wisbys.com, providing all relevant information. We take intellectual property compliance seriously and will promptly investigate all notices received.

  1. Customer Accounts and Information Privacy

 To access certain features of the Site, you may need to create an account. You agree to provide truthful, accurate, and complete information and to maintain its accuracy.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

We are committed to protecting your privacy. All personal data is handled in accordance with our Privacy Policy, which is available on the Site. We comply with UAE privacy laws and applicable international standards.

  1. Authenticity of Products

 Wisbys sources memorabilia from various channels, including direct from athletes, reputable suppliers, auction houses, and private collectors. We are committed to ensuring that all memorabilia we offer for sale is authentic.

For items where authentication is standard or expected—such as autographed items, worn items, limited edition prints, posters, or other collectibles featuring or from an artist, athlete, or other notable individual—Wisbys will ensure that the item includes a third-party certificate of authenticity from a recognised and reputable provider, such as JSA, PSA/DNA, Beckett, ICONS, Topps, the original athlete/artist, original supplier, or an equivalent.

If an item does not already include such a certificate at the time of our acquisition, we will seek to obtain one before offering it for sale, or ensure there is sufficient third-party evidence to reasonably demonstrate authenticity.

We disclose in each product listing whether an item includes a certificate or other supporting evidence of authenticity.

Customers are encouraged to review this information carefully prior to purchase. Except as expressly described in the product listing, no additional warranties or guarantees of authenticity are provided.

  1. Payments

 Wisbys accepts payments through valid credit cards, Apple Pay, Google Pay, PayPal, and other secure payment methods. By entering your payment details, you confirm that you have the authorisation to use the payment method. All payments must be verified before processing an order.

We may make a small temporary charge to verify your payment method; if valid, the charge will be removed.

  1. Shipping and Delivery

 All items are shipped from Dubai, UAE. Delivery times vary based on destination, and shipping charges are calculated at checkout. Wisbys uses third-party providers such as DHL or FedEx for shipping.

  • Shipping: Customers are responsible for providing accurate delivery information. Shipping times and charges vary by destination.
  • Liability: Wisbys is not responsible for lost or damaged items after they have been delivered to the courier service.
  • Customs & Duties: International orders may be subject to import duties, taxes, or other charges, which are the responsibility of the customer.
  1. Returns and Refunds

 If you are unsatisfied with your purchase, you may request a return within 14 days of receipt. All returns are subject to the following conditions:

  • Condition: Items must be returned in their original condition and packaging.
  • Exclusions: Custom, personalised, or framed items are non-returnable unless defective or damaged.
  • Shipping Costs: Return shipping costs are the customer’s responsibility unless the return is due to our error.
  • Damage or Incorrect Items: If your item arrives damaged or is incorrect, you must notify us at info@wisbys.comwithin 72 hours of receipt with photographic evidence. We will work with you to arrange a suitable resolution, which may include repair, replacement, or refund.
  • Approval: All returns are subject to approval. Items returned without prior approval may not be eligible for refund or replacement.
  • Refunds: Approved refunds will be processed within 30 days of confirmation. Refunds will be issued to the original payment method.

  1. Typographical Errors

 While we strive to ensure all pricing and product information on the Site is accurate, errors may occur. If we discover an error in the price of any item you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or cancel it. We are not obligated to honor orders with obvious or unmistakable pricing errors.

  1. SMS Communications

 By providing your mobile number and opting in, you consent to receive SMS text messages from Wisbys, including order updates, service notifications, and marketing offers.

Message frequency may vary. Standard messaging rates may apply. You can opt out at any time by replying “STOP” or by contacting info@wisbys.com.

  1. Disclaimer of Warranties

 All products and services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.

We do not guarantee that the Site or its contents will be error-free, uninterrupted, or free from viruses.

  1. Limitation of Liability

 To the maximum extent permitted by UAE law, Wisbys shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or purchase of products, including but not limited to loss of profits, goodwill, or data.

Our total liability for any claim shall not exceed the amount you paid for the specific product or service at issue.

  1. Indemnity

You agree to indemnify, defend, and hold harmless Wisbys, its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or connected with your use or misuse of the Site or breach of these Terms.

  1. User Conduct

 You agree not to use the Site for any unlawful purpose. You may not upload or transmit content that is harmful, defamatory, obscene, threatening, invasive of privacy, abusive, or illegal.

Harassment in any manner or form on the Site, including via email, chat, or use of obscene or abusive language, is strictly forbidden.

You may not impersonate others, upload commercial content without permission, or solicit others to join any other service or organisation.

  1. Third-Party Links

 Our Site may contain links to third-party websites. These links are provided for your convenience only. Wisbys does not endorse or assume any responsibility for any third-party websites, their content, or their practices.

  1. Force Majeure

 We are not liable for any failure to perform, or delay in performance, due to events outside our reasonable control, including but not limited to acts of God, government actions, natural disasters, pandemics, shipping delays, or telecommunications failures.

  1. Termination

 We reserve the right to suspend or terminate your access to the Site, without prior notice, if you violate these Terms or engage in activities that could harm Wisbys, other users, or third parties.

  1. Notice

 Wisbys may deliver notices to you by email, a general notice on the Site, or by other reliable methods to the address you have provided to us.

  1. Governing Law and Dispute Resolution

 These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be submitted to the exclusive jurisdiction of the Dubai International Financial Centre (DIFC) Courts.

  1. Severability

 If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

  1. Assignment

 You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer our rights and obligations without restriction.

  1. Changes to These Terms

 Wisbys reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Site. It is your responsibility to review the Terms regularly. Your continued use of the Site constitutes your acceptance of any revised Terms.
